Application for Exemption from the Licensing Procedures

Introduction

Section 37 – Children & Young Persons Act 1963 as amended in 1998
The Children (Performances and Activities) (England) Regulations 2014


Some performances maybe exempt from the Licensing Procedures. The person responsible for the production needs to apply 21 days before the first performance as if it is found that a child requires a licence we cannot guarantee the processing of your licence in time for your performance.

Where an Exemption is granted it will be subjected to the following:

• No child will be absent from school due to taking part in the performance or rehearsal.

• No child has performed in the 6 months preceding the performance (including this performance) on more than 4 days.

• The child/ren will be adequately supervised by an adult.

• The latest permitted time at a place of performance is 10.00pm if under 5yrs and 11.00pm if over 5yrs.

• No payment other than expenses in respect of the child taking part is made to the child or another person.

• No child taking part will be employed in any other employment on the day or following day of the performance.

NOTE:

Any person who fails to observe any condition subject to which a licence is granted or knowingly or recklessly makes any false statement in or in connection with an application for a licence is liable to a fine not exceeding £1000 (level 3 on the standard scale) or imprisonment for a term not exceeding three months or both (section 40 of the Children and Young Persons Act 1963).
